Please read Terms and Conditions carefully.

Please be advised, that upon payment of your booking deposit, you agree to accept these terms and conditions.

The Cake:

All Cakes made by Joanne Fraher and The Chic Cake Boutique are subject to the following terms and conditions and privacy policies.

All cakes made delivered/collected will be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in Ireland.

We will not be held responsible for customer disappointment of the design or the interpretation of the cake as long as it is made in line with the customer’s pre agreed requirements set out in the order confirmation and will face no consequent liability.

It is the customer’s responsibility to ensure all details within the order confirmation are correct and meet their exact requirements.

The Chic Cake Boutique will not be responsibility for errors in details including spelling of names provided by the customer at the time of booking.

Quotations are valid for a period of 30 calendar days from the day of issue. Cake sizes quoted are in inches and are based on the diameter of the cake. Cakes are 5  inches deep as standard. However these sizes may vary depending on the design of your cake. 

All stacked cakes will be supported with internal dowels for support which will be placed inside each tier but must be removed before service. There will be a cake board between each tier to make it easy for the hotel to dismantle and cut the cake. Where possible Cakes will be supplied in a box especially designed for cake transportation. 

The cake will be photographed before collection or upon delivery. The Chic Cake Boutique will not take any responsibility for any damage that occurs after collection or delivery of your cake.

The Chic Cake Boutique is not responsible for any Cakes arising from willful damage, accident, negligence by you or any third party, your failure to follow our instructions or any alterations you carry out.

From time to time certain materials for our cakes may become obsolete. This is totally out of our control; however we will do our best to select replacement products to reflect the original design as closely as possible. We reserve the right to replace items with component parts of equal or better quality without consultation.

The cake is a fresh product containing no additives or preservatives and it is our right to assume consumption on the day requested. Any food consumed after these guidelines are at the client’s discretion and becomes their responsibility. Once Cake/ treats have been delivered, the responsibility of consumption lies with the customer and, therefore, indemnify my business of all liability for personal use.

Cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat in the box provided.

Cakes covered with fondant or with sugar decorations should NOT be refrigerated.

The Chic Cake Boutique and the customer agree that the cakes and all goods purchased from The Chic Cake Boutique remain the property of The Chic Cake Boutique until paid for in full.

Cake Design and Consultation: 

All our cakes are made to order. You can browse our portfolio or we can design something unique for you. We cannot guarantee an exact replica of any cake but we will do our best to make it so.

Where colour swatches are provided we will do our best to match as close as we deem possible.

Exact colour matches are not guaranteed.

Please be aware that copyright also protects some designs and, therefore, cannot be copied.

Any samples, drawings, or descriptions we issue and any descriptions or illustrations contained on our website are issued solely to provide you with an approximate idea of the cakes they describe and remain the property of The Chic Cake Boutique.

You have not booked a cake or treats with The Chic Cake Boutique until we have received your deposit. Once your part payment of your wedding cake has been received you are in a legally binding contract with The Chic Cake Boutique.

Tastings:

I can consult with you via email and telephone. Private consultations with be held and are by appointment only, 100€ deposit must be paid prior to consultation. A tasting box is also available for delivery; your cake mail will consist of the most popular cake flavours, delivered to you in a hamper style box to be enjoyed in the comfort of your own home with your family and friends. 100€ deposit must be paid prior to consultation.

Serving sizes:

Our standard cake serving sizes are 1″x1″x5″ high. Cake serving sizes are estimated. Specialty cakes, carved cakes and method of slicing may affect the total serving number. Customer understands and accepts these terms, and must order their products accordingly after having considered these variables. 

Decorating other people’s cakes: 

The Chic Cake Boutique will not provide a wedding cake when sheet cakes, cupcakes, groom’s cakes, cookies or cake pops are provided by any other baker without our permission. We have a reputation to maintain, and it would be unfair for your guests to assume another baker’s cake was our cake. The cake provided by The Chic Cake Boutique will be removed from the venue if another cake as stated above is served at your event.

We do not decorate other people’s work, (if a cake is provided by your granny, mother or aunt we are unable to ice and decorate it as a tier for your wedding cake).

The Chic Cake Boutique does not allow anyone other than The Chic Cake Boutique to add sugar flowers, fresh flowers, cake toppers or figurines to the cake. This is due to health and safety and any tampering with the cake could cause damage to the cake. If such an instance does arise The Chic Cake Boutique is not responsible for any harm or damage caused.

Viewing you cake: 

Please note cakes will not be completed until the day prior to/or the day of the celebration, so for this reason viewing or progress photographs will not be available to the client.

Allergen and Dietary Information. 

All cakes and cake samples supplied by The Chic Cake Boutique contain WHEAT, EGGS  and DAIRY.  All products in the menu are prepared in a kitchen which stores foods that are on the list of allergens. Certain cake in your cake tasting box may contain NUTS, PEANUTS, SULPHUR DIOXIDE and SULPHITES and SESAME SEEDS.

Please be aware that while your cake may not be made with all of these products which may cause allergens, it will have been prepared in a kitchen where these products may be used in other cakes and fillings.

The Chic Cake Boutique does NOT specialize in allergen-free cakes or make cakes with special dietary requirements in mind and cannot provide a complete “free from” environment because of the variety of ingredients we use in the different selection of cakes we produce.

It is your responsibility to inform your guests of this allergy information. We shall not be held liable for any allergic reaction or dietary reaction resulting from consumption of the cake.

  • From the 13 December 2014, all cakes supplied by The Chic Cake Boutique will be labelled in accordance with EU Regulations 1169/2011 on the Provision of Food Information to Consumers.

Customers, who order cakes with allergens or specific dietary requirements, do so at their own risk.

Set Up: 

We are happy to set up your cake at you chosen venue, any props, decorations or fresh flowers(please note fresh flowers are not a food product, Please note some flowers are not suitable for use as a cake decoration).All flowers loose or arranged need to be left at the table where the cake is to be displayed. While we try to ensure that your cake is presented looking its very best, the stability or levelness of the table upon which the cake is displayed or the quality of the surrounding around the cake is not in our control. Please ensure, the ‘cake presentation table’ is stable, level and sturdy enough to hold the cake. A large six tier rich fruit wedding cake can weigh up to 7Kg. Please also remember that chocolate covered, naked, semi- naked and butter cream cakes can melt under extreme conditions as are found within a marquee on a hot summer’s day.

If the cake is to be set up by the venue staff, we will leave instructions on how the cake is to be displayed and obtain a signature to verify that I have done so.

Once the cake is delivered or collected, set-up, and signed for we are not responsible for any interference or damage to the cake or treats.

Cake Pickups: 

Should you choose to collect your cake(s), prior arrangement is required to collect all orders within a time slot mentioned in your order form. A signature is needed for cake collection, confirming that you have received your order in good condition and as specified and you agree The Chic Cake Boutique shall not accept liability for any damage incurred once the cake leaves The Chic Cake Boutique premises.

A lot of cakes are too large or irregular to fit into a cake box so extra care is needed to protect them against damage and contamination. Once the cake(s) has left The Chic Cake premises it is no longer the responsibility of The Chic Cake Boutique. 

The Chic Cake Boutique recommends all wedding cake should be delivered by The Chic Cake Boutique.

Rentals (where applicable):

Additional items (faux cakes, Displays, cake stands, and other rental itfsdfewfewfems must be returned within 3 days of the event date stated on invoice. The deposit is refundable provided the rental item(s) is/are returned in the same exact condition within 3 days. After 3 days, the deposit will be fortified.

Cake Pricing:

Each price given for a cake is a quote and any increase would only be as a direct result of ingredient or energy costs, the final price will be given 8-12 weeks before the wedding date.

Sugar flowers/ Decorations on cakes: 

Although the Chic Cake Boutique uses edible materials to make flowers and Some decorations that are placed on your cake, these are not meant for consumption as flowers and figurines may contain wires and Styrofoam buds, other decorations, such as ribbons, brooches and any edible glitters that are not recommended for consumption as are not very palatable. On your order sheet, we will make the recipient aware of any non-edible items that must be removed before the cake is sliced and served.

All of our figures are handmade, and therefore, whilst we try to capture the characteristics of a particular person if requested (such as with eye colour, hair colour, hair length, glasses etc), we cannot guarantee a true likeness. It is your responsibility to provide images for our reference. If images are not provided standard figures shall be used.

The Chic Cake Boutique recommends that all these items are removed from the cake before cutting and serving it and shall not be held responsible if the correct procedure for removing these items is not followed.

Fresh flowers:

As flowers are not a food product, I will be advising you that organic or edible flowers are a safer option for your wedding cake. 

Fresh flowers are not included in the price of any wedding cake design. If a wedding cake is to be dressed with fresh flowers these are to be provided by your florist. The flowers for your cake need to be delivered to me the day before or delivered to the venue. I do not collect flowers and they must be at the venue before 11 Am. It is up to you to arrange this with your florist. If your florist is not going to the venue it is up to you to deliver the fresh flowers to the venue.

Please note That certain flowers should NEVER be put on your cake.

  1. Edible flowers are those you can eat. taken from the RHS website.
  2. Non-Toxic flowers are those that shouldn’t be eaten, but are considered safe if close to food.
  3. Toxic flowers shouldn’t go anywhere near food as they can cause harm, illness and in extreme cases death.

Edible flowers are those you can eat.

In general it is assumed that only the petals of edible flowers will be consumed. However, there are many beautiful cake designs where the whole flower is stuck to the outside of the cake. Whilst the stamen, calyx, stems etc may all be edible it is advised they are removed before consumption, as they don’t have the best texture.

Non-Toxic flowers are those that shouldn’t be eaten, but are considered safe if close to food.

Non-toxic flowers are those that are not considered to be food, however if used near food are not toxic. These can either be bought from a florist or grown in your garden. Please be aware, if you purchase from a florist chances are the flowers would have been sprayed with pesticides at some point. Pesticides are not always considered food safe so extra care needs to be taken to ensure nothing from the flower leaches into the cake and is eaten.

Below is a list of popular flowers are all Non-Toxic and can be placed on a cake if the cake is protected properly.

Toxic flowers shouldn’t go anywhere near food as they can cause harm, illness and in extreme cases death.

The above are all flowers that can be used on your cake. However, we need to stress there are some flowers and species that should never go near a cake whether they are wrapped well or not. This is because other parts of the flower, for example pollen, oils in the leaves, the stamen, are all dangerous to humans.

The following foliage can also be safely used if the cake is well protected.

Some ferns and firs can also be used. However, be aware these can cause skin irritation for some people.

If I am given toxic flowers by your florist I will not put them on your cake.

Instead I will place them around the base of the cake (not actually touching the cake).

The flowers will be part of the display and not part of the cake.

It is up to you to order the flowers for your cake showing the florist the images you have given me.

For health and safety reasons no one other than The Chic Cake Boutique is to place any fresh flowers into a cake made by The Chic Cake Boutique. If this does happen we cannot be held responsible.

Fresh flowers are not included in the price of any wedding cake design.

FRESH FLOWERS MUST BE REMOVED BEFORE CAKE IS SERVE.

By signing this document, you understand that The Chic Cake Boutique cannot be held responsible for any cake where fresh flowers have been added as, you acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt and or other contaminants.

Weather: 

Heat and humidity can adversely affect your cake. In warmer months, it is advised the cake to be kept in an air conditioned area or, at the very least, a cool area. (Refrigeration is not recommended for fondant cakes).

It is strongly suggested that cakes being collected by the customer be transported in an air-conditioned vehicle.

You understand that I am in no way responsible for any damage that may occur due to weather conditions.

  • Outdoor events: The Chic Cake Boutique is not responsible for any weather damage after delivery and cake set up. Below is a list of certain guidelines to avoid adverse effects of various weather conditions.
  • Heat: Butter cream cakes, naked and semi naked cakes can melt and therefore are not recommended for indoor or outdoor events where temperatures may exceed 20°C.
  • Humidity: Fondant/ gumpaste can melt and bubble in very humid weather.
  • Wind: Can knock over and damage items, it can also blow debris or bugs onto your cake.
  • Rain: Fondant may get spotted by rain and change and/or melt colours and fondant as well as other structures 
  • Coloured Icings:  The exact colour pink, blue, purple, black or any deep dark colours cannot be guaranteed as they are unstable, and could fade and/or bleed into surrounding colours when exposed to different conditions, sunlight, heat, humidity, moisture etc.

Delivery: 

Delivery should be arranged at the time of ordering your cake. 

It is your responsibility to ensure that you have provided correct delivery information and to ensure that the venue is open and available at the arranged date. At the venue, should we have to wait to gain entry, you will be billed for the time at a rate of 30€ per hour. If no-one is available to receive the cake at the agreed delivery time, your order will be returned to my business and we will contact you to arrange an alternative delivery time; for which a charge will be payable. My company accepts no responsibility for any loss or consequential loss incurred by the customer as a result.

The Chic Cake will always do the best it can to ensure delivery dates agreed are achieved for the provision of the goods or services however the Company cannot accept liability for delays and time shall not be of the essence.

When delivering to a wedding venue, we will contact the venue in advance to arrange a mutually convenient time for delivery. We will take a photograph of the cake at the venue after set up is complete and speak to the manager where possible in the venue confirming the cake has been received in good condition. Once the cake has been delivered we are unable to accept and liability for any damage sustained to the cake thereafter nor any failure to follow the instructions provided.

If the cake is delivered with a stand, a security deposit will be payable with the final balance. The stand must be returned to us in a good, clean condition within 48 hours of the wedding. Upon the return of the stand (in the same condition as it was delivered to the venue) the deposit will be refunded. If stands are not returned within 48 hours or returned in a condition that is different to the condition it was delivered in, you the customer are liable for the cost of this stand and will lose your deposit.

Release of liability: 

The Chic Cake Boutique will make every possible effort to create and safely deliver your cake. Once delivery and set up is complete, The Chic Cake Boutique will not assume any responsibility for your guests, hotel staff, catering staff, photographer or any persons act with regard to your cake, or any property damage, injury that occurs as a results of our services and/or provisions of your cake.

The Chic Cake Boutique shall have no responsibility for the condition of the cake once delivered to you, collected by you or delivered to your wedding venue.

High temperatures or damp cold areas can affect your cake; it is your responsibility to arrange with the venue an appropriate spot for the cake, away from direct sunlight, unnecessary heat and not in a damp room.

Price and Payment

The price of your cake will be as set out in your order confirmation. A part payment (deposit) is required for wedding cake and occasion cakes orders. For Wedding Cakes a detailed order confirmation will be issued detailing the final balance and payment details. No further payment reminders will be sent and it is the responsibility of the client to ensure payment is on time. Full payment is required four weeks before the wedding.

Please note all partial payment are strictly non refundable.

The balance must be paid in cleared monies no later than four weeks before the wedding by bank transfer to the account specified or cash.

If payment is not received by the date specified this shall be constituted as breach of contract by the client. We reserve the right to hold the order until payment is made in full. When payment is late we accept no responsibility should we be unable to purchase the required stock or equipment to make the cake as laid out in the order confirmation. In these circumstances the cake will be made as close to the order confirmation as possible with no redress or liability on The Chic Cake Boutique.

Part payments:

All part payments become due to once you have placed, checked and confirmed the details of your order. We will hold your date no later than one week after booking. After this time, your date is not guaranteed and will still be available to other customers. We will not treat your order as accepted until your part payment (deposit) has been received. Your order will not be booked until part payment (deposit)is paid in full.

  •  All celebration cake orders require a non-refundable part payment of 50%. Short notice orders that are placed within one month of the collection date are an exception to this and must be paid in full on ordering.
  • For wedding cakes, a non-refundable part payment of 100 Euro is required to secure your order. Short notice orders placed within six month of the wedding date are the exception to this; they should be paid in full at the time of ordering.

Please note that all part payments are NON-REFUNDABLE and NON-TRANSFERABLE. If you cancel your order deposits paid are strictly NON-REFUNDABLE.

In the unlikely event that we need to cancel your order, any payments paid will be FULLY REFUNDED. Reasons we may need to cancel – death, injury, illness (due to health and safety regulations), severe medical conditions or an accident of myself or any immediate family member.

  • By paying this part payment you agree with all Terms and Conditions.

Final Balance Payments:

  •  For celebration cakes, the balance can be paid in cash one month. If you wish to pay the balance by cash, cheque (will need to clear before cake is collected) or direct transfer.
  •  Final payment for your wedding cake is required no later than four weeks before your collection/delivery date. We will not release your cake to you until payment has been received in full. We accept no responsibility for any loss howsoever caused for non-delivery under these circumstances.

Non-Payments: Please note, if full payment of the wedding cake is not received 30 days before the delivery, collection and set-up date, it is assumed that the cake has been cancelled. The cancellation policy, therefore, applies in all cases. If after the 28-day deadline you try to make payment, we reserve the right to refuse your trade in all cases with complete loss of your part payments.

Cake Design alterations: 

Your cake is important to us so; please take the time to check the details of your quote/order carefully. It is your responsibility to contact us of any changes required to your original order. We will try and accommodate any changes where possible. We cannot guarantee to do so and reserve the right to increase the price quoted for any extra work required.

Any changes or amendments or cancellations to your order prior to 8 weeks before the wedding day, or 14 days for celebration cakes, must by providing to us via written notice. In the case of alterations a new order confirmation will be issued detailing the changes and the new cost. Alterations are not confirmed until a new order confirmation has been issued. Should you make any changes after that time there will not be a reduction in the price you pay, even if your new design is cheaper than the original booking.

Any changes made to your original design are subject to a change in the quoted price. Included are supplies that may no longer be needed but have already been purchased. Please note we are unable to make any changes within seven days of the delivery/collection date for celebration cakes or within four weeks of the wedding date.

Artistic License: 

Each cake and decorative finishes are handmade with the finest ingredients by The Chic Cake Boutique. You may bring/send Photographs of designs you like, however this is subject to interpretation as I cannot create an exact duplicate of work done by other decorators, as that would violate creative copyrights.

Cancellation Policy:

Orders can be cancelled up to one month prior to the occasion; In the event of a cancellation by yourselves, you forfeit the part payment. Any payments previously made are non refundable also.

Orders cancelled within one month of the date of delivery must be paid in full. In the event that something occurs that effects your scheduled occasion date please feel free to contact us to discuss other options.

In the event of a postponement, or rearrange your occasion date we will try our best to accommodate these changes at no additional charges; provided sufficient notice is given and that we can offer a cake for the re-arranged occasion date. We will do our best to accommodate your order but CANNOT GUARANTEE to be able to do so. If we are already fully booked for your new occasion date and unable to provide the cake, it would not be possible to refund your part payment(deposit). Please bear this in mind when ordering, as any monies paid are non-refundable and non-transferable. We highly suggest that you take out wedding insurance to cover all eventualities. Please be aware that we will only do this on one occasion. Any further postponements will be classes as a cancelation.

In the unlikely event that we need to cancel your order any monies paid will be refunded. The Chic Cake Boutique reserves the right to cancel, vary or suspend the operation of this contract if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies or any other event outside the control of The Chic Cake Boutique, and The Chic Cake Boutique shall not be liable for any breach of contract resulting from such an event.

Complaints:

Where damage does occur at the irrefutable fault of my business, a partial or full refund may be given, this will be determined on an individual basis. Proof must be provided immediately, either in person or by way of pictorial evidence. The customer is made aware that specific designs (e.g., topsy-turvy) are more structurally sensitive than others; improper handling can lead to damage. Assuming all precautions have been taken by us, to provide you with a sound structural support; we accept no liability for any damage that may occur once the cake is in the customer’s possession.

Complaints are very rare and due to the amount of work put into each individual cake we take them very seriously. Any issues must be bought to our attention within 48 hours on collection or delivery to give fair opportunity to assess the nature of the complaint.

Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website without providing advance written notice of the intended content thereof, and providing the other party with a prior opportunity to resolve any issues between the parties amicably.

Complaints regarding the decoration of celebration cake can be easily repaired so errors of this nature must be pointed out upon delivery/collection so as to give us the opportunity to correct them. Once payment has been handed over this confirms that decoration is as requested and no further claims can be made.  It is the client’s responsibility to check that this meets with their requirements and raise any issues with us if there are any discrepancies.

Where the complaint is in regards to the quality of the cake then the cake, or remainder of the cake/tier, must be returned to us as soon as possible after cutting and within 48 hours of collection/delivery to ensure that we are able to fairly assess the nature of the complaint.

Please note we can only deal with the client who placed the original order.

Use of Photographs:

The Chic Cake Boutique reserves the right to photographs of your cake for our own reference, display or promotional advertising without compensation to you. In the event we receive a photograph from you or your photographer, we reserve the right to use it for our own reference, display or promotional advertising without compensation to you. Photographs will be credited to the photographer according to agreement between The Chic Cake Boutique and the said photographer.

Awards:

From time to time The Chic Cake Boutique may be nominated for awards, you as a customer (recent or current) may be contacted and asked about your experience with The Chic Cake Boutique.

Personal data we collect:

As we are providing a service to you we will need certain information, this will include, your name, address, email, phone number and other relevant information about the event or occasion you need the cake for. All information is disposed of in the correct manner after the event.

Privacy policy:

This means that The Chic Cake Boutique will only use your data or share it with our trusted third-party suppliers when necessary to provide you with our service as per our Terms and Conditions and updated Privacy Policy. If The Chic Cake Boutique does not obtain your consent, we will not be able to provide you with our services.

We do not disclose any of your personally identifiable information to outside parties. This does not include trusted third parties (the other suppliers you have chosen to hire for your event), so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety.

General Terms:

All designs and intellectual property rights remain the property of The Chic Cake Boutique.

This Agreement together with Order Confirmation documents provided constitute the entire agreement and understanding between the parties relating to the order. Except as may be expressly stated in this Agreement, it supersedes and cancels all prior agreements, statements, representations, understandings, negotiations and discussions, whether oral or written, between the parties. Each of the parties acknowledges and agrees that in entering into this Agreement it does not rely on any statement, representation, warranty or understanding made prior to this Agreement save to the extent that such statement, representation, warranty or understanding is incorporated into this Agreement. Each of the parties acknowledges and agrees that in entering into this Agreement it has not relied on (or has been induced to enter into this Agreement by) any statement, representation, warranty or understanding made prior to this Agreement. Nothing in this paragraph excludes any liability for fraudulent misrepresentation.

In the event that any one or more such provisions of this Agreement should be deemed to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity and enforceability of the remaining valid and enforceable provisions thereof which shall be construed as if such invalid or unenforceable provisions had not been inserted.

Any headings utilized in this Agreement have been inserted for the convenience of reference only and should in no way restrict or otherwise affect the construction of the terms and conditions hereof.

Please be advised, that upon payment of your booking deposit, you agree to accept these terms and conditions.
